Terms of Service

In short

This summary helps you read the terms; it doesn't replace them.

1. This agreement

These terms are an agreement between you and Fingerprint Creative Inc. (“Genmodic”, “we”, “us”), a corporation registered in state, for your use of the Genmodic website, editor, player, marketplace, AI features and related services (together, the “Service”). By creating an account, buying something or using the Service, you agree to these terms and to the policies they link to:

If you use Genmodic for a company or school, you agree for that organisation and confirm you're allowed to. Education and Enterprise customers may have a signed agreement; where it differs from these terms, the signed agreement wins.

2. Who can use Genmodic

3. Your account

Keep your password private and your email address current; we use it for confirmations, replies to your support requests and important notices (Stripe sends payment receipts). You're responsible for what happens on your account. Tell us at hello@genmodic.com straight away if you think someone else has used it. One person per account: Studio and Education plans are licensed per seat.

4. What's yours

Your worlds. The worlds, scenes, films, pictures and other things you make (“Your Content”) are yours. We don't claim ownership of them. Library models placed in your world stay ours or our licensors'; what you may do with them is set out in the Model and export licence.

The licence you give us. So we can run the Service, you give us a worldwide, non-exclusive, royalty-free licence to store, copy, process, display and send Your Content, only as needed to provide, secure and improve Genmodic for you: for example saving your worlds, making thumbnails, showing a world to the people you share it with, and listing public worlds in Explore and on your profile. When a world is public or unlisted, this includes showing it to visitors. The licence ends when you delete Your Content, except for copies in backups for a limited time, worlds other people have bought (which stay available to them; see the Creator Terms), and anything we must keep by law.

We don't train AI on your worlds. We don't use Your Content, prompts or photos to train AI models, and our AI providers don't either. See AI features.

Your promises. You confirm you have the rights to everything you upload or import (models, photos, sounds, text), and that Your Content follows the content rules.

Ideas and feedback. If you send us suggestions, we may use them without owing you anything.

5. What's ours

Genmodic, its software, design, the Genmodic name and mark, and the premium model packs belong to Fingerprint Creative Inc. or its licensors and are protected by copyright, trademark and other laws. We give you a personal, non-exclusive, non-transferable, revocable licence to use the Service under these terms and your plan. You may not:

Third-party models in the free library come under their own open licences (for example CC0, MIT or CC-BY 4.0), listed in Credits and third-party notices. Where those licences give you more rights, they apply to those models.

For using the Genmodic name in your own work, see Using the Genmodic name.

6. Plans, payments and renewals

Prices and what each plan includes (credits, online worlds, online storage, film quality and licence) are shown in the app before you buy; online storage is per plan, and each file you upload can be up to 95 MB. Payments are handled by Stripe. Paid plans renew automatically each month or year at the price you subscribed at until you cancel, and we charge the payment method on file at the start of each period. You can cancel any time from Manage billing in your account; you keep the plan until the end of the period you've paid for. We'll tell you at least 30 days before a price change applies to you. Refunds, credits, packs, and world and model purchases are covered in Plans, purchases and refunds. Prices don't include taxes unless shown; we add sales tax or VAT where we must.

7. Sharing, Explore and the marketplace

Worlds are private until you choose Unlisted or Public. A public world appears in Explore and on your profile, with your handle. Anyone who can see a world can play it. If you sell worlds, the Creator Terms apply as well. If you buy a world, the purchase rules in Plans, purchases and refunds apply. Genmodic isn't the seller of creators' worlds or models; we run the marketplace and collect payment on the creator's behalf.

Models. Anyone with a profile can publish free models to the model marketplace; Pro and above can sell them. A model you get from it can be used in any of your own worlds, including ones you share or sell, but can't be listed again or exported (see the licence).

Reviews and wishlists. You can review a world you've played or bought (not your own): one review each, which you can change or delete. Reviews are public, under your handle (or as "A player"), with how many times you played. Your wishlist is private to you. We may remove reviews that break the content rules.

8. AI features

The Director, rocks from a photo, our support assistant and other AI features use outside AI models and are covered by AI features. AI output can be wrong, unexpected or similar to things others have made; review it before relying on it or publishing it.

9. Reports, removals and account closure

We may review, hide or remove content, and limit, suspend or close accounts, if we reasonably believe they break these terms or the law, put others at risk, or expose us to legal liability. Where we can, we'll tell you why and give you a chance to respond. You can appeal by replying to our notice or writing to hello@genmodic.com. Copyright complaints follow the takedown process, including our repeat-infringer policy.

Closing your account. You can stop using Genmodic and ask us to delete your account at any time (see the Privacy Policy). If we close your account for a serious or repeated breach, you may lose access to purchases on it, and paid time isn't refunded unless the law requires it. If we close it for any other reason, we'll refund the unused part of a prepaid plan.

10. Changes to Genmodic and these terms

Genmodic changes over time: we add, change and sometimes remove features. If we remove something central to a paid plan, we'll tell you first and, if you then cancel, refund the unused part of your period. We may update these terms. For significant changes we'll tell you by email or in the app at least 30 days before they apply. If you keep using Genmodic after that, the new terms apply; if you don't agree, cancel before then.

11. No warranties

To the extent the law allows, the Service, its models and AI output are provided “as is” and “as available”, without warranties of any kind, including merchantability, fitness for a particular purpose, non-infringement and uninterrupted or error-free operation. Keep your own copies of important worlds: use Download to save a world file. Some places don't allow these exclusions, so some may not apply to you.

12. Limits on liability

To the extent the law allows, Fingerprint Creative Inc. and its people won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from the Service. Our total liability for any claim about the Service is limited to the greater of (a) what you paid us in the 12 months before the claim and (b) US $100. Nothing in these terms limits liability that can't be limited by law, such as for fraud, or for death or personal injury caused by negligence.

13. Your responsibility to us

If someone makes a claim against us because of Your Content or your breach of these terms, you'll cover our reasonable costs and losses from that claim, to the extent the law allows. This doesn't apply to consumers where the law forbids it.

14. Disputes and governing law

Please contact us first: most problems can be solved quickly at hello@genmodic.com. These terms are governed by the laws of the State of state and US federal law, without regard to conflict-of-law rules. Disputes go to the state or federal courts in county, state, and you and we agree to their jurisdiction; either of us may instead bring an individual claim in small-claims court. If you're a consumer in the EU, the UK or another country whose law gives you the right to sue at home or under your local consumer law, you keep that right.

With the lawyer: whether to add binding individual arbitration and a class-action waiver for US users, with an opt-out.
